Man, 26, found innocent in sex case

 

WETUMPKA -- An Elmore County jury took about two hours Wednesday morning before returning an innocent verdict in a child sex case.

Robby Ziegler, 26, faced one count of sex abuse of a 4-year-old girl. The abuse allegedly occurred in late December 2004 and early January 2005, according to trial testimony.

"This is why you have jury trials, to allow 12 people to weigh the evidence and make the decision," said District Attorney Randall Houston. "We believed the child, otherwise we never would have gone to trial. We accept the jury's decision."

During the hearing Tuesday, the girl's mother testified that she didn't believe Ziegler was guilty. Tracy Birdsong, Zeigler's attorney, told the jury in her opening arguments that the sex abuse charge was a byproduct of a custody struggle between the alleged victim's mother and grandmother.
