Tallassee police officer has been cleared of any criminal action by the Elmore County Grand Jury in connection with a fatal shooting that occurred Dec. 29, 2009. Michael McIntyre was shot and killed that day, court records show. A special session of the grand jury met Friday to hear evidence in the case, said District Attorney Randall Houston. The panel determined the officer's actions included "no indictable offense" and that the discharging of his weapon was "justified and done in the line of duty," the grand jury report stated. Several officers went to an apartment complex that day in Tallassee to serve an attempted murder warrant on another person, Houston said. McIntyre was in the apartment and would not follow police officers' orders when they entered, the prosecutor said. McIntyre fled the apartment, several officers gave chase. During the pursuit McIntyre produced a pistol, and an officer shot him, Houston said. The shooting was investigated by the Alabama Bureau of Investigation, standard procedure when an officer fires their weapon, Houston said. The grand jury also heard testimony from the Alabama Department of Forensic Sciences and officers with the Tallassee Police Department and Elmore County Sheriff's Office, court records show. |
